    ترجمة المفاهيم المتعلقة بالنظام القضائي الجزائري في الأحكام القضائية من العربية إلى الإنجليزية: دراسة تحليلية مقارنة لترجمات مكاتب ترجمة عمومية لقرارات مأخوذة عن مجلة المحكمة العليا

    يتناول هذا البحث إشكالية ترجمة المفاهيم المتعلقة بالنظام القضائي الجزائري في الأحكام القضائية من اللغة العربية إلى اللغة الإنجليزية. وتهدف الدراسة إلى الكشف عن التقنيات الترجمية التي تمكّن المترجم من تجاوز الصعوبات المرتبطة باختلاف الأنظمة القانونية وتباين المفاهيم المتعلقة بالنظام القضائي بين النظام القضائي الجزائري والنظامين القضائيين الإنجليزي والأمريكي. تضم الأطروحة أربعة فصول، تناول الأول منها المفهوم المتعلق بالنظام القضائي وترجمة الأحكام، بينما خصص الثاني لدراسة عنصر اختلاف الأنظمة القانونية وتباين المفاهيم المتعلقة بالنظام القضائي. أما الفصل الثالث فقد ركز على التقنيات المعتمدة في الترجمة، وكرّس الفصل الرابع لدراسة تحليلية مقارنة لترجمات أربعة مترجمين رسميين لنماذج من المفاهيم المتعلقة بالنظام القضائي والتي تم انتقاؤها من مجموعة قرارات قضائية أخذناها من مجلة المحكمة العليا. وقد خلصت الدراسة إلى أن تقنية التكافؤ الشكلي هي الأكثر استعمالًا، وأكدت على أهمية الاستعانة بالقانون المقارن لاختيار المفهوم المكافئ. This study explores the challenge of translating concepts related to the Algerian judicial system in judicial decisions from Arabic into English. It aims to identify translation techniques that help translators overcome difficulties arising from differences between legal systems and conceptual gaps between the Algerian, English, and American judical systems. The thesis includes four chapters. The first introduces concepts related to the judicial system and the translation of judicial decisions. The second examines divergence among legal systems and concepts related to the judicial system. The third focuses on techniques used in translating these concepts.     فاعلية الترجمة الآلية في ترجمة القوانين الجزائريّة بين العربية والإنجليزية دراسة تجريبيّة مقارنة لثلاثة برامج ترجمة آليّة: غوغل- ريفيرسو-سيستران

    تناول بحثنا المعنون "فاعلية الترجمة الآلية في ترجمة القوانين الج ا زئرية بين اللغتين العربية والإنجليزية: د ا رسة تجريبية مقارنة لثلاثة ب ا رمج ترجمة آلية: غوغل، ريفيرسو، وسيست ا رن " تقييم أداء أدوات الترجمة الآلية في نقل النصوص القانونية الج ا زئرية. وركزنا من خلاله على د ا رسة نقاط القوة والضعف في هذه الأدوات، ومدى قدرتها على مساعدة المترجم البشري في تسريع عملية الترجمة والتعامل مع مختلف القوانين الج ا زئرية . وقد قسّمنا د ا رستنا إلى أربعة فصول: ثلاثة نظرية، وفصل تطبيقي، قمنا فيه باختيار نماذج من أربعة قوانين ج ا زئرية، ترجمناها باستخدام الب ا رمج الثلاثة، ثم حلّلنا النتائج ورصدنا الأخطاء، وقمنا بتصنيفها وفقًا لمستويات التحليل اللغوي . ومن أبرز نتائج البحث تباين أداء ب ا رمج الترجمة الآلية الثلاثة، رغم اعتمادها جميعًا على مقاربة الترجمة الآلية العصبية، كما أظهرت النتائج تفاوتًا في الفاعلية من قانون إلى آخر، وكذلك من مستوى لغوي إلى آخر، ما يدل على أن أداء هذه الأدوات يختلف بحسب طبيعة النص ومستوى التحليل اللغوي المعتمد )المعجمي ، التركيبي ، الدلالي، أو التداولي( . Our research, entitled "The Effectiveness of Machine Translation in Translating Algerian Codes Between Arabic and English: An Experimental Comparative Study of Google, Reverso, and Systran," aims to evaluate the performance of machine translation tools in translating Algerian legal codes. It examines their strengths and weaknesses, as well as their potential to assist human translators. The study is organized into four chapters: three theoretical and one practical. In the practical chapter, we selected excerpts from four Algerian codes, translated them using the three tools, and analyzed the outputs. Errors were identified and categorized according to linguistic levels. The results reveal significant differences in performance among the tools, despite their shared use of neural machine translation. Effectiveness varied not only between the different codes but also across linguistic levels—lexical, syntactic, semantic, and pragmatic—highlighting the impact of text type and linguistic complexity on translation quality.
