أثر النصوص التشريعية على التسيير الذاتي للمتاحف الجزائرية (المراسيم المتحفية :1985 - 2011 م)

Abstract

تهدف هذه الدراسة إلى البحث في النصوص التشريعية المتعلقة بالمتاحف الجزائرية ، والجوانب التي عالجتها هذه التشريعات من خلال مدى استجابتها لمتطلبات المتحف الجزائري و تطوراته ، خاصة و أنها لم تعرف تنظيما تشريعيا إلا سنة 1985م، وهو تاريخ صدور القانون النموذجي للمتاحف، والذي على أساسه بدأ التسيير الإداري للمتاحف الجزائرية. وقد حافظ المشرع على نفس النص تقريبا من 1985 إلى 2011 غافلا في كل إصدار على الجانب التقني في تسيير وحفظ المجموعات المتحفية، وبشكل عام لم تعكس هذه التشريعات حاجة المتحف الجزائري، وذلك رغم توالي صدور المراسيم المتحفية إلا أنها لحد اليوم لا تواكب متطلبات المتحف المعاصر. This study aims to research the legislative texts related to Algerian museums, and the aspects addressed by these legislations through their response to the requirements of the Algerian Museum and its developments, especially since it did not know a legislative organization until 1985, which is the date of the issuance of the Model Law for Museums, on the basis of which the management began Administrative of the Algerian museums. The legislator kept almost the same text from 1985 to 2011, oblivious to every issue on the technical aspect of managing and preserving museum collections, and in general, this legislation did not reflect the need of the Algerian Museum, as despite the successive issuance of museum decrees, to date it does not keep pace with the requirements of the contemporary museum
