دراسة تحليلية لنص المادة 72 من قانون الأسرة الجزائري

Abstract

في حالة الطلاق يلتزم الأب بتوفير مسكن ملائم للممارسة الحضانة، وإن تعذر ذلك فعليه دفع بدل الإيجار، وتبقى الأم الحاضنة في بيت الزوجية حتى تنفيذ الأب للحكم القضائي المتعلق بالسكن، طبقا لما هو وارد في نص المادة 72 من قانون الأسرة الجزائري، والتي تعتبر النص الوحيد الذي ينظم مسألة مسكن ممارسة الحضانة. إلا أن هذه المادة جاءت متضمنة للكثير من الغموض والإشكاليات سواء كان ذلك من الناحية النظرية أو التطبيقية في ساحة القضاء، حيث نجد من بين هذه الإشكاليات أن المشرع الجزائري نص على عبارة سكن ملائم، التي تمنح للحاضنة حق تقدير مدى ملائمة المسكن تحت رقابة القضاء، خاصة وأنه يحتاج إلى العديد من المستلزمات والنفقات التي تلحقه، وبالتالي فإن المشرع لم يبين لنا الشروط الواجب توافرها في مسكن ممارسة الحضانة.

In the case of divorce, the father is obliged to provide a suitable dwelling for the practice of custody. If this is not possible, he must pay a rent. The incubator stays in the marital home until the father implements the judicial ruling on housing, as stipulated in article 72 of the Algerian Family Code organizes the issue of the domicile of nursery. Despite this, this present article contains many ambiguities and problems, whether in theory or practice in the field of justice. Among these problems is that the Algerian legislator provided for the appropriate housing, which gives the incubator the right to assess the appropriateness of the house under the supervision of the judiciary, and that he needs many of the requirements and expenses incurred, and therefore the legislator did not show us the conditions that must be available in the nursery practice of custody.
