Abstract

يعالج هذا البحث اشكالية كفالة الاطفال في الجزائر ودور القانون الجزائري في حماية هذه الفئة من الضياع والتشرد وتفكك الأسري بسبب التكفل الغير المشروط بين الطرفين وما ينجر عنه من سوء فهم معنى الكفالة التي تعتبر عقد انساني قبل أن يكون عقد أو التزام قانوني بين الطرفين، فمن خلال هذا البحث المتواضع سوف نرى من خلال دراسة ميدانية لحالة من الاطفال الذين يعانون من هشاشة الكفالة التي أدت ببعضهم الى التشرد والبعض الأخر الى مراكز إيواء الطفولة المسعفة، بمعنى : "وجودهم خارج سقف العائلة"، التي تعتبر نواة المجتمع. وكيف صور لنا المثل الشعبي قضية التكفل بالأطفال وتربيتهم.
