التكافؤ في ترجمة المتلازمات اللّفظية في النص التشريعي بين الفرنسية والعربية

Abstract

نتناول في سياق العبارات شبه الجامدة مسألة درجة التكافؤ في ترجمة المتلازمات اللفظية الواردة في قانون العقوبات الجزائري، متخذين اللغة الفرنسية لغة الانطلاق واللغة العربية لغة الهدف. وفي هذا الصدد، نستهل الشق النظري بتحديد خصائص اللغة التشريعية ومن ثمّ النص التشريعي بشكل عام وفي خضم السياق الجزائري بشكل خاص. كما نستعرض مفهوم المتلازمات اللفظية من منظور اللغات الغربية (الفرنسية والإنجليزية) والعربية. ثم نتطرق إلى الترجمة التشريعية واستراتيجية التكافؤ فضلا عن درجة التكافؤ بشكل عام وفي المجال التشريعي بشكل خاص عند ترجمة المتلازمات اللفظية. علاوة على ذلك، نخصص الشق التطبيقي لتقديم المدونة، ألا وهي قانون العقوبات الجزائري، ويليه عرض للخطوات التقنية المتبعة لتصميم معجم المتلازمات اللفظية (فرنسي/عربي) باستخدام برنامج "أكسس" (Access). كما نكرس الفصل الأخير للدراسة التحليلية النقدية للمكافئات العربية للمتلازمات اللفظية الفرنسية المنتقاة. وفي الأخير، ننهي أطروحتنا بخاتمة تشمل أهم النتائج المتوصل إليها من خلال الدراسة التطبيقية In the context of semi-frozen expressions, we discuss the issue of the degree of equivalence in translating collocations in the Algerian Penal Code, taking French as the starting language and Arabic as the target language. To this end, we begin the theoretical part by addressing the characteristics of the legislative language and then those of the legislative text in general and in the Algerian context in particular. We also review the concept of collocations from the perspective of Western languages (French and English) and Arabic. We then discuss the legislative translation and the equivalence strategy in addition to the degree of equivalence in general and in the legislative field for the translation of collocations. In addition, we devote the practical part to the presentation of the corpus, namely the Algerian Penal Code, followed by the technical steps dedicated to the development of a lexicon of collocations (fr / arb) using "Access" software. In the last chapter, we proceed to the analytical and critical study of the Arabic equivalents of the selected French collocations. Finally, a conclusion in which the main results of the practical study are recalled will close our thesis
