L’impact des violences conjugales sur les enfants- la priorité de prise en charge

Abstract

Domestic violence is not without consequences on the children,the latter whogrow up in such a context live in the fear, the insecurity and the confusion. The children of violent fathers are often physically mistreatedat the same time as their mother.If it is not the case,they are daily or almost brought to witness domestic violence.However, for a child, witness this violencemeans, in the same way as having himself been mistreated. These consequences are such as the Algerian legislator did well to insert an arrangementdepriving the violent spouse of the mitigating circumstances if the breach was committed in the presence of the minors; this in paragraph 4 of the article 266 bis 1 of the bill concerning the violence made for the women amending and completing the prescription 66-156 of June 8th, 1966 carrying the penal code,adopted by the National Assembly while waiting for its adoption by the Senate.This arrangementis more than important to protect the child of violent father.Hence the care of this child is a priority. To answer this problem,we shall approach the consequences of this form of violence on the children, then of the necessity and the priority of coverage. لايخلو العنف الزوجي من عواقب بالنسبة للأطفال، حيث الأطفال الذين ينشئون في هذه البيئة يعيشون في الخوف وانعدام الأمن والارتباك، فالأطفال من الآباء العنيفين غالبا مايتعرضون لسوء المعاملة جسدي اإلى جانب والدتهم . إذا لم تكن هذه هي الحالة، فهم شهودا للعنف الزوجي. في حين، بالنسبة للطفل الشاهد للعنف حتى وإن كان لم يتعرض للعنف كأنه هو الذي تعرض لسوء المعاملة. لما للعنف الزوجي أثار خطيرة، فأحسن المشرع الجزائري عند إدراجه حرمان المعتدي من الظروف المخففة إذا كانت الجريمة قد ارتكبت في وجود الأطفال القصر، وهذا في الفقرة 4 من المادة 266 مكرر 1 من مشروع قانون بشأن العنف ضد المرأة، المعدلة والمكملة لأمر 66-156 من 8 يونيو 1966 المتضمن قانون العقوبات، الذي اعتمده المجلس الشعبي الوطني في انتظار اعتماده من قبل مجلس الأمة. فهذه الفقرة أكثر من مهم لحماية الطفل من أب عنيف. ومن هنا رعاية هذا الطفل من الأولوية؟ للإجابة على هذه الإشكالية نتطرق لآثار العنف على الأطفال، ثم لأولوية رعاية هذا الطفل. Les violences conjugales ne sont pas sans conséquences sur les enfants, ces derniers qui grandissent dans un tel contexte vivent dans la peur, l’insécurité et la confusion. Les enfants de pères violents sont souvent physiquement maltraités en même temps que leur mère. Si ce n’est pas le cas, ils sont quotidiennement ou presque amenés à être témoins de violences conjugales. Toutefois, pour un enfant, être témoin de ces violences revient au même titre que d’avoir été maltraité lui-même. Ces conséquences sont tels que le législateur algérien a bien fait d’insérer une disposition privant le conjoint violent des circonstances atténuantes si l’infraction a été commise en présence des enfants mineurs, ceci en alinéa 4 de l’article 266 bis 1 du projet de loi relatif à la violence faites aux femmes amendant et complétant l’ordonnance 66-156 du 8 juin 1966 portant le code pénal, adopté par l’APN en attendant son adoption par le Sénat. Cette disposition est plusqu’importante afin de protéger l’enfant de père violent. D’où la prise en charge de cet enfant constitue une priorité. Pour répondre à cette problématique, nous aborderons les conséquences de cette forme de violence sur les enfants, puis de la nécessité et de la priorité d’une prise en charge.
