Abstract:
لقد جاءت التشريعات و القرارات و التعليمات الفرنسية في الجزائر منذ بداية الاحتلال لتعطي عملية النهب و التشريد صبغتها القانونية الرأسمالية الاستعمارية، هذه القوانين التي زاوجت بين قانون القوة و قوة القانون في الاستيلاء على الأرض و احتقار السكان و تشريدهم و ترحيلهم خارج وطنهم و السيطرة على ممتلكاتهم و محو شخصيتهم و استبدال ايديولوجيتهم الثقافية..لقد باغت اندلاع الثورة الجزائرية السلطات الفرنسية التي اتّسمت ردود فعلها الأولية بالاضطراب و هوما سمته السلطة الفرنسية "زلزالاً جديداً", و بذلك أفرطت فرنسا في إصدار قوانين
و قرارات تفتِّن للعنف و الوحشية بهدف القضاء على الثورة ، غير أن هذا العنف أدى إلى نتائج عكسية كانت في صالح جبهة و جيش التحرير الوطني.. كان خط الثورة محدد الأهداف و معروف الوسائل، فهي قضية عادلة و مشروعة و كان من مظاهرها التناسق في البيانات و المواثيق من بيان أول نوفمبر إلى ميثاق طرابلس، و هو ما مكّن من قهر فرنسا و نيل الاستقلال و دحر الآلة العسكرية و المنظومة القانونية الفرنسية.
French legislation, decisions and instructions came in Algeria since the beginning of the colonization to give the process of looting and displacement its colonial capitalist legal character, these laws have paired between the law of force and the force of law in seizing land, contempt of the population, displacing and deporting them outside their homeland, controlling their property and replacing their cultural ideology. The outbreak of the Algerian revolution surprised the French authorities, whose initial reactions were characterized by turmoil, which the French authority called a "new earthquake", and thus France overissued laws and decisions that fascinate violence and brutality in order to eliminate the revolution, but this violence backfired in favor of the Front and the National Liberation Army. The line of revolution was targeted and with known means, it is a just and legitimate issue and one of its manifestations was the harmonization in statements and charters from the statement of November 1st to the declaration of Tripoli congress which enabled the conquering of France, gaining independence and defeating the military machine and the French legal system
