تحسين جودة الصياغة القانونية بين العربية والانجليزية نصوص قانونية نموذجا

يشكل موضوع تحسين جودة الصياغة القانونية تحديا كبير سواء للمترجمين أو رجال القانون من مشرعين و موثقين و غيرهم ذلك لأن جودة الصياغة تقلل من التأويل الخاطئ للنصوص القانونية مما يؤدي إلى ضياع الحقوق أو تقديم ترجمات مغلوطة قد تثير النزاع، قادنا التفكير إلى طرق التفسير و التأويل القضائي ماهيته و أنوعه و وسائله التي قد تساعد المترجم في عمله كما خضنا غمار الصياغة القانونية لنتعرف على أصول الصياغة القانونية باللغتين العربية و الانجليزية وأهم الصيغ المستعملة و خصائص الجملة القانونية التي تضمن جودة و تماسك النص القانوني. و لا يتأتى تحسين النصوص القانونية دون تقييمها لأن التقييم يمكن من تقديم ملاحظات وتعليقات بناءة بخصوص الترجمات كما يمكن من التعرف على مواطن ضعفها و العمل على تحسينها وكان نموذج كاتارينا رايس و تقنيات الترجمة أهم وسائل التقييم المعتمدة، ولعل أهم ماخلصنا إليه هو أن الصياغة الدقيقة تقلل من التأويل الخاطئ و أن المترجم المطلع على أصول الصياغة القانونية باللغتين المنقول منها و المنقول إليها وعلى طرق التأويل القضائي قد جمع له منهج متكامل لصياغة نصوص قانونية جيدة. Legal drafting quality improvment constitute a major challenge for legal professionals including legislators, notaries and others, that is quality of drafting reduces the misinterpretation of legal texts which leads to rights loss or incorrect translations that may raise disputes. Our thinking directed us to judicial interpretation: its nature, types and means that may help translators in their endeavour, we also included the principales of legal drafting and the most important wordings, and the characteristics of the legal sentence that guarantee legal texts quality and coherence. It is not possible to improve legal texts quality without assessing them, that is assessment enables observe and comments translations effectivly. It also enables us to identify their weaknesses and attempt to improve them; we noticed that Rice’s model and translation techniques were the most important methods of evaluation. The most important conclusion drawn is that precise drafting reduces misinterpretation, and that familiarity with the principles of legal drafting in Arabic and English and the methods of judicial interpretation give access to an integrated approach to drafting good legal texts
ترجمة المفاهيم المتعلقة بالنظام القضائي الجزائري في الأحكام القضائية من العربية إلى الإنجليزية: دراسة تحليلية مقارنة لترجمات مكاتب ترجمة عمومية لقرارات مأخوذة عن مجلة المحكمة العليا

يتناول هذا البحث إشكالية ترجمة المفاهيم المتعلقة بالنظام القضائي الجزائري في الأحكام القضائية من اللغة العربية إلى اللغة الإنجليزية. وتهدف الدراسة إلى الكشف عن التقنيات الترجمية التي تمكّن المترجم من تجاوز الصعوبات المرتبطة باختلاف الأنظمة القانونية وتباين المفاهيم المتعلقة بالنظام القضائي بين النظام القضائي الجزائري والنظامين القضائيين الإنجليزي والأمريكي. تضم الأطروحة أربعة فصول، تناول الأول منها المفهوم المتعلق بالنظام القضائي وترجمة الأحكام، بينما خصص الثاني لدراسة عنصر اختلاف الأنظمة القانونية وتباين المفاهيم المتعلقة بالنظام القضائي. أما الفصل الثالث فقد ركز على التقنيات المعتمدة في الترجمة، وكرّس الفصل الرابع لدراسة تحليلية مقارنة لترجمات أربعة مترجمين رسميين لنماذج من المفاهيم المتعلقة بالنظام القضائي والتي تم انتقاؤها من مجموعة قرارات قضائية أخذناها من مجلة المحكمة العليا. وقد خلصت الدراسة إلى أن تقنية التكافؤ الشكلي هي الأكثر استعمالًا، وأكدت على أهمية الاستعانة بالقانون المقارن لاختيار المفهوم المكافئ. This study explores the challenge of translating concepts related to the Algerian judicial system in judicial decisions from Arabic into English. It aims to identify translation techniques that help translators overcome difficulties arising from differences between legal systems and conceptual gaps between the Algerian, English, and American judical systems. The thesis includes four chapters. The first introduces concepts related to the judicial system and the translation of judicial decisions. The second examines divergence among legal systems and concepts related to the judicial system. The third focuses on techniques used in translating these concepts. The fourth presents a comparative analysis of translations conducted by four This study explores the challenge of translating concepts related to the Algerian judicial system in judicial decisions from Arabic into English. The study concludes that formal equivalence is the most commonly used technique in translating concepts related to the algerian legal system, and emphasizes the importance of comparative law in finding accurate equivalents.
