Item استراتيجية الإقناع والتواصل في المرافعات والمذكرات - الخطاب القضائي الجزائري في محكمة بجاية أنموذجا-(جامعة الجزائر2 أبو القاسم سعد الله Algiers2 University Abu El Kacem Saad Allah, 2024) نعلوف, كريمة Karima; بلخير, عمر (مدير البحث)يتناول هذا البحث بالدراسة والتحليل استراتيجية الإقناع والتواصل في المرافعات والمذكرات – متخذا الخطاب القضائي في محكمة بجاية عينةً للدراسة وفق مقاربة تداولية، إذ حاولنا في هذا البحث أن نتوقف عند الاستراتيجيات المعتمدة في دراسة الخطاب القضائي عبر ثلاثة فصول تمثلت في فصلٍ أولٍ تناول الجهاز المفاهيمي للتداولية والخطاب القضائي، تلاه فصلٌ ثانٍ تطرّقنا فيه إلى تحليل المحادثة والعملية التواصلية داخل قاعة المحكمة بين القاضي وأطراف النزاع، مع الإشارة إلى استراتيجية الانتقال من اللغة العربية الفصحى إلى لغة أخرى، في حين تناول الفصل الثالث الجانب الحجاجي في الخطاب القضائي، وذلك من خلال التطرّق إلى أفعال الكلام، ومختلف الاستراتيجيات الحجاجية التي تتبلور عبر مراحل الخطاطة الحجاجية في المنطوق والمكتوب. This research examines and analyses the strategy of persuasion and communication in the pleadings - taking the judicial discourse in the Bejaia court as a sample of the present study according to a deliberative approach. In this research, we have tried to focus on the strategies adopted to study judicial discourse in three chapters. The first chapter deals with the conceptual body of deliberation and judicial discourse. In the second chapter, we have discussed the analysis of the conversation and communication process in the courtroom between the judge and the various parties with reference to the strategy of transition from classical Arabic to another language. The third chapter sheds light on the argumentative aspect of judicial discourse by addressing the various argumentative strategies through the different phases of oral and written argumentative discourse
