الأرشفة الإلكترونية في الهيئات القضائية

Abstract

إن ظهور التقنيات الحديثة للمعلومات دفع معظم المؤسّسات والهيئات إلى اعتماد الأرشفة الإلكترونية كخيار استراتيجي، لحفظ الوثائق في مستندات إلكترونية يسهل استرجاعها والتعامل معها، وهو ما سلّطنا الضوء عليه من خلال هذه الدراسة التي تناولت واقع تطبيق الأرشفة الإلكترونية في الهيئات القضائية الجزائرية. وقد حرصنا في هذه الدراسة على إلقاء الضوء على الأرشفة الإلكترونيةوتوضيح احتياجاتها المختلفة والمراحل المعتمدة في تطبيقها، إضافة إلى توضيح أهم العمليات الفنية المعتمدة في إدارة الوثائق بنظم الأرشفة الإلكترونية، أمّا ميدانيا فقد عالجنا تطبيق الأرشفة الإلكترونية في مجلس قضاء عين الدفلى والمحاكم الابتدائية التابعة له، من خلال التعرّف على أهم المتطلبات والدعامات المعتمدة في ذلك ، معتمدين في ذلك على المنهج الوصفي كمنهج أساسي لوصف الظاهرة، ومستخدمين كذلك مجموعة من أدوات البحث العلمي على غرار الملاحظة، المقابلة، الاستبيان وبعض المراسلات الإدارية المساعدة في جمع البيانات. حيث توصلت الدراسة إلى جملة من النتائج أكدت توفّر متطلبات مادية وبرمجية معتبرة، ووجود قصور في السياسة المنتهجة التي كان ينقصها الدقة والوضوح سواء على مستوى التخطيط والتنظيم أو على مستوى تأهيل الكوادر البشرية المكلفة بأرشفة الوثائق القضائية، كما أظهرت الدراسة اعتماد عدة آليات وإجراءات أمنية بغرض حماية الوثائق الإلكترونية من المخاطر. لتخلص الدراسة في النهاية إلى تقديمجملة مقترحات لتطوير الأرشفة الإلكترونية في الهيئات القضائية المدروسة. The emergence of modern information technologies led most institutions and agencies to rely on electronic archiving as a strategic option in order to preserve documents in electronic files that are easy to retrieve and deal with.This is what we highlighted through this study, which dealt with the reality of the application of electronic archiving in the Algerian judicialinstitutions. In this study we shed light on electronic archiving and clarify its various needs and the stages adopted in its application. In addition to clarifying the most important processes adopted in document management in electronic archiving systems, as for the field we dealt with the application of electronic archiving in AinDefla court and its dependent primary courts, by identifying the most important requirements and adopted supports, relying on the descriptive approach as a basic method to describe the phenomenon, and also used a setoff scientific tools such as the interview, the questionnaire and some administrative correspondence to assist in data collection. The study reached a set of results that confirmed the availability of significant material and softwareequipments, and the existence of shortcomings in the adopted policy, which lacked accuracy and clarity, whether at the level of planning and organization or at the level of qualification of the staff in charge of the archiving judicial documents. The study also showed the adoption of several security mechanisms and measures in order to protect documents from risks. In the end, the study concludes with a proposed vision for developingof electronic archiving in the judicial institutionsunder study.
