الأسس الاتصالية للاستجواب كأسلوب لدفع عمل المحقق الجنائي

Abstract

ملخص: تهدف الدراسة الحالية إلى محاولة تشخيص أهم الأساليب والتقنيات الاتصالية وأسسها النفسية في عمليات الاستجواب باعتبار هذا الأخير يخدم التحقيق الجنائي، لذلك لجأنا إلى التعامل مع مجموعة من رجال الشرطة الذين تعدت خبرتهم عشر سنوات في التحقيق من خلال عقد مقابلات معهم، وتم استخدام دليل مقابلة ضم أسئلة مفتوحة هدفها الحصول على بيانات فنية يقرونها، وتم التوصل من خلال إجاباتهم إلى كم معتبر من الأساليب النفسية الاتصالية التي يحترفونها أثناء الاستجواب الجنائي، نذكر منها:التحضير للاستجواب واستغلال المعطيات الجنائية المتحصل عليها خلال التحقيق، تكييف الأسئلة وفقا للفئة المتعامل معها، محاولة التعامل مع مقاومة المستجوبين من خلال تطوير آليات المواجهة كالاستشهاد بالقرائن والأدلة والربط بين الأحداث والاستنتاج. وأخيرا الاعتماد على تقنيات اتصالية لفظية وغير لفظية يطورها بفضل خبرته الميدانية. Abstract: The current study aims to identify the most significant skills and communication techniques and their psychological fundaments in the interrogatory process, which helps a lot in investigating crimes. We conducted many interviews with a group of policemen with more than ten years of experience in the field of crime investigation. These interviews led us to obtain details about their highly skillful ways to deal with the interrogated criminals, like the preparation of questions before the conduct of the interrogatory and the use of all information gotten from the investigation, the adaptation of the questions according to the person interrogated, facing resistance during the interrogatory by using strategies such as confronting suspects with proofs, fact analysis, deduction… and finally using verbal and non-verbal communication skills when conducting an interrogatory. Résumé: La présente étude vise à identifier les compétences, les techniques et les fondements psychologiques de la communication utilisés lors des interrogatoires. A cet effet, nous avons mené des entretiens avec un groupe de policiers ayant plus de dix ans d’expérience dans le domaine des enquêtes criminelles, ce qui nous a permis de déduire que ces derniers s’appuient sur des méthodes de communication extrêmement habiles lors du déroulement de l’interrogatoire, tels que la préparation des questions avant de mener l'interrogatoire et l’utilisation de toutes les informations recueillies lors de l'enquête, l’adaptation des questions en fonction de la personne interrogée, faire face aux résistances lors de l'interrogatoire en utilisant la confrontation des suspects avec les preuves, l’analyse des faits et les déductions, et enfin l’utilisation des techniques de communication verbales et non verbales lorsqu’ils effectuent un interrogatoire.
