إشكالية ترجمة النص القانوني بين الحرفية والتكافؤ من الفرنسية إلى العربية )د ا رسة تحليلية مقارنة لترجمة نماذج من إعلانات واتفاقيات أممية(

Abstract

يتناول بحثنا إشكالية ترجمة النص القانوني من الفرنسية إلى العربية و على وجه الخصوص نصوص الإعلانات و الاتفاقيات لدى هيئة الأمم المتحدة التي تتولى حل النزاعات الدولية من خلال إحداث التوافق بين الشعوب حيث تولي هذه الهيئة أهمية بالغة للترجمة بشكل عام و الترجمة القانونية بشكل خاص نظرا إلى أنها تسهل عملية التواصل بين الدول و لا يتأتى لها ذلك إلا بإبرام إعلانات و اتفاقيات دولية . كما يهدف بحثنا إلى كيفية نقل هذه النصوص المتسمة بالرسمية و التي لا تحتمل الخطأ في الترجمة أو سوء استعمال المصطلحات التي قد ينجر عنها عواقب وخيمة . وتوصلنا إلى أن المترجمين قد اعتمدوا على نقل المعنى باستعمال التكافؤ الدينامي الذي يرتكز على إحداث الأثر ذاته في نفسية القارئ مع اختلاف الأبنية الشكلية و التكافؤ البراغماتي الذي يركز على المعنى الضمني و إهمال الشكل بالإضافة إلى اعتماد التكافؤ الشكلي الذي يتقيد بالأبنية الشكلية و يركز على النص المصدر . Our research deals with the issue of translating UN texts from French into Arabic , particularly declarations and conventions which has the role of settling international conflicts through creating agreement between peoples , in fact , this entity gives a great interest to translation in general and to legal translation in particular because it facilitates the communication between States and this can't be realized without concluding international declarations and conventions . It also aims to show the methods of translating these official texts in which error can't be tolerated either in their translation and the bad adopted terminology that may have severe consequences on those states We deduce that the translators have used the dynamic equivalence and the pragmatic one to express the sense and the implicit to the reader as well as they slightly used the formal equivalence which complies with the form of the source text
