دور مؤسسة الحسبة في محاربة الآفات الاجتماعية في الأندلس السرقة وشرب الخمر " انموذجين"

Abstract

الملخص: كان لمؤسسة الحسبة في الأندلس في القرن الخامس الهجري وعلى رأسها المحتسب ومعاونيه دورا هاما على ساحة الرقابة والضبط الاجتماعي من منطلق الأمر بالمعروف والنهي عن المنكر ، ومما ساعدهم في ذلك طبيعة عملهم الذي يحتّم عليهم مراقبة كل ما يجري في المجتمع من نشاط يومي وما ينجر عنه من مخالفات شرعية سواء أكان في أعلى هرم السلطة إذ يتحتّم على تلك المؤسسة إرشاد ولاة الأمور في اختيارهم من هم أهل لتولي المسؤوليات كالحكام وأعوانهم والوزراء والقضاة وأعوانهم وكاتبو الوثائق والحرس والعرفاء ....وغيرهم ، وكذا مراقبة المؤسسات والمنشآت من دور ومساجد وأسواق وطرقات وحمامات ... وما يدور فيها من معاملات يومية للحد من الغش والتدليس والمنكرات التي يحدث يوميا . ونظرا لكون مؤسسة الحسبة قريبة من موقع الحدث فإنها بإمكانها ممارسة مهامها بصورة أفضل وأحسن لما تلك المؤسسة من اطلاع ومعرفة لما يجري في المجتمع بفضل المحتسبين ومساعديهم ،وما يملكونه من سلطة ورهبة لزجر كل ما هو مخالف للشرع ، وعليه فقد وقع اختيار دراستي على دور تلك المؤسسة في محاربة الآفات الاجتماعية في مجتمع الأندلس خلال القرن الخامس الهجري ـــــــــــ آفتي السرقة وشرب الخمرــــ "أنموذجين" معتمدا في ذلك على بعض رسائل الحسبة وأخص بالذكر سيما تلك الرسائل التي عالجت هذا الموضوع بدقة متناهية والموسومة ب "ثلاث رسائل في الحسبة " لكل من ابن عبدون وابن عبد الرءوف والجرسيقي ، تلك الرسائل التي عملت على تشريح واقع المجتمع الأندلسي في تلك الفترة وما يدور فيها من آفات اجتماعية ودور مؤسسة الحسبة في محاربتها Abstract : It is generally agreed that Al HISBA as a social institution has a crucial role in the society. More precisely in the fifth century AlMOHTASIB and his supporters had a great impact in terms of social control and social adjustment. In this sense, they control everything in society as well as daily events and illegal practices even at high levels of the authority. In this case, they intend to guide and orient the leaders to choose convenient ministers, judges and their supporters. They also make control on different institutions such as Mosques, markets, streets, and baths… the reason for that is fighting illegal phenomena that happen in these institutions. Al HISBA as a closed institution to reality, it can practice its duties in a perfect way. In addition, AL HISBA institution has great deal of information concerning what happen in the society due to AL MOHTASIB and his supporters. They have the authority to prevent all things that are illegal. For those very reasons, this study aims to investigate the role of AL HISBA institution in fighting the social phenomena in terms of drinking wine and theft. More precisely, the study aims to shed light on these phenomena in terms of the Andalusian society in the fifteenth century Hidjri. This work is based on “Three Letters of AL HISBA" that are Ibn Abdoun, Ibn Abd Arraouf, and Aljarsiki. Those letters investigated the social phenomena in the Andalusian society and the role of ALHISBA in fighting these phenomena Résumé: ‘’El Hasaba’’ est une institution qui a été crée au 5 ème siècle hyjri en Andalousie comme un organe de conseil et d’aide à la décision dans le domaine de la gouvernance et d’action sociale. Nous étudierons fous ces aspects à travers l’analyse de contenu de trois lettres rédigées par trois illustres personnalités : Iben Abdoun, Iben Raouf et El Djarssiki.
