واقع الايداع القانوني في الجزائر وأثره على اثراء الإرث الثقافي والفكري الوطني

Abstract

ملخص: منذ قرابة خمسة قرون (1537م. فرنسيس الأول، فرنسا) تقوم مختلف المؤسسات الوطنية في العالم بجمع وتسجيل وتنظيم واتاحة التراث الثقافي والفكري للدول من خلال الزام قانوني يسمى الايداع القانوني الذي يعتبر أعرق آلية للضبط الببليوغرافي التي تحفظ وتصون الارث الثقافي والفكري في مختلف أقطار المعمورة. ان المكتبة الوطنية هي احدى الهيئات الرئيسية المكلفة بالإشراف على هذه العملية حيث تعتبر المرجع الأساسي والمركزي للإنتاج الفكري الوطني و نقله الى الأجيال المقبلة. نهدف من خلال هذا المقال دراسة واقع التطور التشريعي للإيداع القانوني في الجزائر ومدى تأقلمه مع المصادر الحديثة للمعلومات وكذا تحديد آليات تطبيقه في المكتبة الوطنية الجزائرية و محاولة حصر أهم العراقيل الادارية والتنظيمية التي تواجهها هذه المؤسسة العريقة للحفاظ على التراث الثقافي الوطني. Abstract: The law of legal deposit defines the mechanisms for bibliographic control, preservation and control of cultural heritage in different parts of the world. The National Library is one of the main institutions responsible for overseeing and monitoring the implementation of this law. This article is a study of the legislative evolution of the legal deposit in Algeria, its application, its adaptation with the new media of the information. We will also focus on the implementation mechanisms followed by the Algerian National Library in the field of legal deposit, focusing on the effects of the administrative and organizational obstacles that it encounters on the enrichment of the national, cultural and intellectual heritage. Résumé: La loi du dépôt légal définit les mécanismes permettant le contrôle bibliographique, la préservation et le contrôle du patrimoine culturel dans différentes parties du monde. La Bibliothèque nationale est l'une des principales institutions chargées de superviser et de contrôler l’application de cette loi. Nous proposons dans cet article l’étude de l'évolution législative du dépôt légal en Algérie, l'étendue de son application, son adaptation avec les nouveaux supports de l’information. Nous nous intéresserons également aux mécanismes d'application suivis par la Bibliothèque nationale algérienne en matière du dépôt légal en mettant l’accent sur les effets des obstacles administratifs et organisationnels qu’elle rencontre sur l’enrichissement du patrimoine culturel et intellectuel national.
