Abstract

بعدما كانت مغلقة على نفسها وظروف تواصلها مع العالم الخارجي شبه منعدمة، أضحت المؤسسة العقابية اليوم عبارة عن مؤسسة للإصلاح وإعادة الإدماج الاجتماعي للسجين، تحفظ له كرامته وتبقي فيه الأمل في الحياة بطريقة مغايرة ،عكس ما كان عليه الحال من قبل. الحق في البيئة المفتوحة من حقوق إنسان السجين الذي يبدي حسن سلوكه ورجوعه لإنسانيته على عكس نظام البيئة المغلقة التي أعاقت برامج الإصلاح والتأهيل بفعل الحراسة المشددة والأسوار العالية التي يصعب معها تأهيل المسجون للحياة السوية اللاحقة على الإفراج عنه. جاءت هذه الدراسة لتسليط الضوء على مبادئ المعاملة الإنسانية للسجين كآلية فعالة للتأهيل وإعادة الإدماج الاجتماعي. الكلمات الدالة: السجين-المعاملة الإنسانية-إعادة الإدماج الاجتماعي-المؤسسة العقابية T After being closed to itself and the circumstances of its connection with the outside world, the penal institution is today a foundation for the reform and social reintegration of the prisoner, which preserves his dignity and keeps the hope of life in a different way, unlike what has been the case before.
