Abstract

يتناول هذا البحث تحقيق مخطوطة للشيخ أبي العباس أحمد بابا التنبكتي السوداني ت: 1036هـ، الفقيه المحدّث المدرّس، شيخ فقهاء المغرب العربي خلال القرن الحادي عشر الهجري، موضوعها مسألةٌ جزئيّة دقيقةٌ من فقه الأيْمان من مختصر الشّيخ خليل، وما توهمه عبارتُه فيها من إشكالٍ، هي مسألةُ تخصيص عموم لفظ الحالف بنيته، هل يشترط فيه التّنافي بين مقتضيي اللفظ والنّية؟ ثمّ متى تقبلُ دعوى الحالفِ إرادةَ خلافِ ما تُفهِمه عبارته؟ هل يسوّغ ذلك في الفتوى؟ أم في القضاء؟ أم فيهما معًا؟ وما حداني إلى تحقيق هذه الرّسالة هو قدرُ مؤلّفهَا أوّلاً، ثمّ قيمتها العلميّة ثانيًا، من حيثُ ما تعكسه من مبلغ عناية فقهاء الغرب الإسلاميّ عامّة وفقهاء أفريقيا خاصّة بالمختصر الخليليّ، وتحقيق مسائله وتدقيق عباراته. Abstract: This research deals with the investigation of a manuscript by Sheikh Abi al-Abbas Ahmad Baba al-Tanbukti al-Sudani d .: 1036 AH, the jurist of the Maghreb during the eleventh century AH. The issue of specifying the general term of an oath with his intention, is it required that there is a contradiction between the requirements of the word and the intention? Then when will you accept the case of the sworn in order to disagree with what his phrase understands? Is this justified in the fatwa? Or in the judiciary? Or in them together? What led me to the realization of this message is the value of its author first, then its scientific value second, in terms of what it reflects in terms of the amount of concern of the Islamic West's jurists in general and African jurists in particular with the Khalili acronym, and the fulfillment of his issues and the scrutiny of his phrases.
