موقف المالكية من التعليل المقاصدي

Abstract

تتناول هذه الدراسة موضوعا من موضوعات علم أصول الفقه المتعلّق بقضية تعليل الأحكام في مجال العبادات والعادات، ومعرفة موقف المالكية من ذلك، لذلك تطرقت الدراسة إلى محاور عدة، تمثلت في محاولة ضبط تعريف التعليل عند المالكية، ثم بيان معنى التعليل في المجال التعبدي والعادي عندهم، وضوابطه في كلا المجالين. وقد تبيّن من خلال هذه الدراسة أن التعليل منهج له أثر كبير في المذهب المالكي، ويظهر ذلك في أن أغلب أحكام الشريعة الإسلامية معللة بتحقيق المصالح أو دفع المفاسد. This study deals with one of the topics of the fundamentals of jurisprudence related to the issue of explaining rulings in the field of worship and customs, and knowing the position of the Malikis on that. Therefore, the study touched on several axes, represented in the attempt to control the definition of reasoning for the Malikis, then explain the meaning of reasoning in the devotional and ordinary domain for them. And its controls in both areas. It was found through this study that reasoning is a method that has a great impact on the Maliki school of thought, and this is evident in that most of the provisions of Islamic law are justified in achieving interests or warding off evil.
