Item القواعد الخاصة بمتابعة الطفل الجانح في التشريع الجزائري(الاسرة والمجتمع-الاسرة و التنمية والوقاية من الانحراف و الاجرام-كلية العلوم الاجتماعية-جامعة الجزائر2 ابو القاسم سعد الله, 2021-06-30) خطاب, كريمةأقرت التشريعات تنظيما خاصا في إجراءات التحري والتحقيق والمحاكمة بشأن الأطفال الجانحين، يختلف عن التنظيم الخاص بالبالغين، وسبب ذلك أن جنوح الطفل يرجع إلى صغر سنه وعدم قدرته على الإدراك والاختيار لعدم نضج الوعي الاجتماعي والذهني والعقلي والنفسي والعاطفي والجسمي لدى الطفل، هذا ما يبرر وجود قواعد جزائية خاصة بالطفل، نظمها قانون 15/12 الصادر في 15 جويلية 2015 المتعلق بحماية الطفل، وهذه الإجراءات تمر بعدة مراحل بداية بمرحلة جمع الاستدلالات، مرورا بمرحلة التحقيق ثم مرحلة المحاكمة. Legislation has established a special organization for investigation and trial procedures of delinquent children, which differs from the regulation for adults, and the reason for this is that the child’s delinquency is due to his young age and his inability to perceive and choose because of his social, mental, psychological, emotional and physical immaturity. This justifies the existence of child-related penal law, organized by Law 15/12 of July 15, 2015 related to child protection, and these procedures go through several stages, beginning with the collection of evidence, through the investigation stage and then the trial phase.Item حجاجية المثل في القرآن الكريم من خلال كتاب الأمثال لابن القيم(مجلة حوليات جامعة الجزائر2, 2022-06-30) بومقواس, محمدنسعى في هذا البحث إلى الإجابة عن سؤال مفاده: ما القيمة الحجاجية التي يحملها المثل في القرآن الكريم؟ حيث أن المثل عموما، و في القرآن خاصة يعد من الأساليب التي تزاوج بين الإمتاع والإقناع، لذا كان المثل وسيلة ناجعة في ميدان الحجاج، وهذا ما جعلنا نطرح فرضيات عديدة، تكون إجابة للتساؤل الأول، فقد بحثنا في هذه الآلية المُقنعة (المثل) عن طريق الـدراسـة والتحليل للحجاج و المثل بمنهج وصفي مكننا من الإحاطة بالمفهومين بوضوح، ثم بحثنا في عناصر المثل، مادته وشكله لنصل إلى القوة الإقناعية بمنهج تحليلي، وباستعمال الوسائل المنطقية واللغوية التي وظفها العلماء العرب والغرب، سعيا لإبراز القدرة الحجاجية للمثل في القرآن الكريم. In this research, we seek to answer the question: What is the argumentative value of the proverb in the Holy Qur’an? As the proverb in general, and in the Qur’an in particular, is one of the methods that marries pleasure and persuasion, so the proverb was a useful tool in the field of pilgrims, and this is what made us put forward many hypotheses, which are an answer to the first question. The study and analysis of pilgrims and proverbs with a descriptive method enabled us to understand the two concepts clearly, then we examined the elements of the proverb, its substance and form, in order to reach the persuasive power with an analytical method, and by using the logical and linguistic means employed by Arab and Western scholars, seeking to highlight the pilgrimage capacity of the proverb in the Holy Qur’an.
