الزواج على عرف سيدي معمّر في شرشال " جذوره التاريخية و مميّـزاته من خلال الوثائق الأرشيفية "

Abstract

تزخر الجزائر بكميات هائلة من الوثائق الأرشيفية الخاصة بالقرن التاسع عشر و بداية القرن العشرين ميلادي، ومن بينها وثائق المحكمة الشرعية الخاصة بمنطقة شرشال، و التي تعرفنا بدواخل المجتمع إنطلاقا من الأسرة و الأهمية التي لعبتها في ترسيخ عادات وتقاليد الزواج للمجتمع الشرشالي. إن الولوج إلى مؤسسة الزواج و الأسرة في منطقة شرشال إنطلاقا من وثائق سلسلة المحكمة الشرعية وخاصة عقود الزواج يعدّ مجالا خصبا لم يستغل بعد إستغلالا كليا، فقد كشفت لنا هذه العقود عن جوانب هامة من الواقع المعاش داخل الأسرة الشرشالية، و خاصة الزواج و ما يتعلّق به من شروط و جهاز و صداق و أعراف و طقوس.... و لعل من أهم الزيجات التي وردت في مضمون العقود تلك التي عقدت على العرف و هذا نتيجة لأن بعض الأسر الشرشالية تبنت هذا النّوع من الزواج، فلم يكن عرفي سيدي معمر و سيدي مروان الوحيدين بل كانت هناك عقود زواج على أعراف مختلفة أخرى عددها كان قليلا مقارنة بالعرفين الأولين لكنها تساوت في رمزية مبلغ صداقها. فلماذا تبّنت بعض الأسر الشرشالية الزواج على العرف؟ وهل اقتصرت الزيجات على عرفي سيدي معمر و سيدي مروان فقط؟ و هل تعرفنا الوثائق على الجذور التاريخية لعرف سيدي معمر في شرشال؟ و ماهي أهم مميزاته؟ و هل شكّل هذا العرف خصوصية المجتمع الشرشالي في زيجاته؟ Algeria is endowed with enormous quantities of archival documents during the nineteenth century and in the beginning of the twentieth century, including documents of the Shariah Court for the Churchal Region, which is known for the community's involvement in the family and the importance it has played in consolidating the customs and traditions of marriage for the Shariah society. Entering into the institution of marriage and family in the Shirshal area on the basis of the forensic court series of documents, especially marriage contracts, is a fertile area that has not yet been fully exploited. These contracts have revealed to us important aspects of the pension reality within the Sharqali family, especially marriage and related conditions, organs, friendship, customs and rituals.... Perhaps one of the most important marriages in the content of the contracts that have been concluded on custom. As a result of the fact that some Sharqiya families adopted marriage on custom, it was not only Arafi Sidi Muammar and Sidi Marwan, but there were marriage contracts on various other customs whose number was little compared to the first two but equally symbolized the amount of their friendship. So why did some Sharjah families adopt marriage on custom?
