دلالة الأمر القضائي في ضوء الاستراتيجيّة التّوجيهيّة (صحيح البخاري أنموذجًا)

Abstract

يسعى هذا البحث إلى دراسة مفهوم الاستراتيجيّة التّوجيهيّة في الحديث النّبوي من خلال فحص دلالة أداة الأمر في توجيه الخطاب وآلية اشتغالها في سياق التّقاضي، على اعتبار أنّها من أبرز أدوات الاستراتيجية التّوجيهية استخدامًا. وإننا نتطلع من خلال إمعان النظر في معطيات النّماذج التّطبيقية وتحليلها في ضوء مفهوم الاستراتيجية التّوجيهيّة إلى الكشف عن صور توظيف أداة الأمر في مختلف دعاوى الاحتكام، إلى جانب رصد خصائص الخطاب القضائي في العهد النّبوي، والتّحقق من مدى قدرة أداة الأمر في الاستراتيجية التوجيهية على استيعاب مدلولات الخطاب القضائي، والتعبير عن الأحكام القضائيّة والشّرعيّة في الموضوعات المتنازع عليها. الكلمات المفتاحية: تحليل الخطاب، الاستراتيجية التوجيهية، الأمر القضائي، الحديث النبوي. Abstract: This research aims to study the concept of directive strategy in the Prophetic Hadith through examining the indication of the command tool in speech addressing and identifying its work mechanism in the context of litigation. Through examining the data of the applied models and its analysis, we are looking to reveal the ways of using the warrant tool in various litigation cases. The research also focuses on the characteristics of the judicial discourse in the Prophetic era. It also attempts to verify to which extent the warrant tool in directive strategy is able to absorb the meanings of the judicial discourse and express judicial and Sharia rulings on the disputed topics.
